Well, this is getting interesting (14th)
-
Pelosi is talking up the 14th Amendment, adopted as a consequence of our first civil war.
Looks like a simple majority vote can remove the offending members, presumably those who challenged the electoral process after the attack on the Capitol.
Whatever you may think of Nancy Pelosi, she has a backbone of steel.
Section 3
No person shall be a Senator or Representative in Congress...shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.
Section 5
The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.
-
@just-jeepin That letter reads as made up to me. But apparently it is indeed legit: https://www.speaker.gov/newsroom/11021-0
Though frankly having it posted as a press release is even weirder.
-
@just-jeepin I'm curious what the burden of proof is? I'd love to see some of the Senators and Congresspeople kicked out but there must be a process on how to determine and confirm their involvement.
-
@krustywantout I think there's a case to be made that, after the insurrection, you persisted in supporting an obvious attempt to subvert the election you're guilty by definition, and whether you challenged the electoral votes is an easy way to define the line there.
I think the GOP Senators might go along with the ringleaders like Cruz and Hawley, but I doubt they'd accept kicking out all of the guilty parties, but this is so far into uncharted territory I have no real idea what might happen.
-
@krustywantout seems you just need a 2/3 majority vote
From the 14th amendment.
"But Congress may by a vote of two-thirds of each House, remove such disability."
So, unlikely to happen since it would require 2/3 of both chambers.
-
@mastermario the 2/3rds vote is to allow them to be in Congress. Simple majority to boot them.
-
@just-jeepin where are you getting that from? This is the whole 14th amendment, section 3...
"No Person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."

@just-jeepin said in Well, this is getting interesting (14th):
our Kristallnacht
I know Arnold used this comparison, but I wouldn't use it if I were you... Even though comparisons with Hitler and the Nazis' political methods are somewhat valid, you cannot separate Hitler/Nazism from genocide. What has happened is bad enough without any exaggeration (which is why I also hesitate on domestic terrorism, even though it's probably warranted for some of these assholes).
Kristallnacht was an act against a people (the Jews). This Wednesday was an act against our democracy (and all her citizens). Where there vocal racists in that crowd? Absolutely. But they were after Pence, Pelosi, etc. in the riot.
Insurrection is the correct term.
-
@mastermario It's effectively a double negative causing the confusion.
The "disability" is the inability to serve if you participated in an insurrection. So by a 2/3rds vote Congress can decide to let you in anyway.
-
@davesaddiction Yeah, I definitely should not have been flippant with that word. I'll remove it.
-
@mastermario said in Well, this is getting interesting (14th):

Is just a simple majority needed to agree that one is guilty of this?
-
@davesaddiction So it appears.
-
@just-jeepin Gotcha...that makes more sense.
-
@davesaddiction Maybe closer to our version of the Reichstag fire. Hopefully the path is derailed there.
-
@fintail Let's hope. I won't feel at ease until after the 20th.
We're all going to learn very soon just how much our government is surveilling every one of its citizens. Just imagine if Trump had figured out a way to take hold of these mechanisms and turned them to his will (using blackmail, or outright threats against other lawmakers and officials to help keep himself in power).
-
@davesaddiction I won't feel at ease even after the 20th. Security staff for the new regime have to be questioning their chosen line of work, the lunatics are not going to make things easy on them.
I've always believed government had pretty tight surveillance, just choosing not to do anything about it most of the time. Nobody is anonymous. Fortunately, I like to think most lawmakers, on the D side especially, wouldn't be scared if 45 dared such threats, knowing so much of the public loathes him (of course, so much of the public is also in a cult supporting him). He must be impeached, or otherwise prevented from holding any office again.
-
@fintail 38% approval on the 7th (day after). Insanity...
I sure hope that number drops 10% when they run it again, now that there's so much evidence it wasn't Antifa doing all of this. Ugh.
How could so many of my fellow citizens be taken in by this con man, and brainwashed by his disciples? Are the vast majority of American minds that weak?!
-
@davesaddiction I have no doubts about it. It will take a lot more than an attempted coup for the cult to abandon their dear leader.
Proud Boys coward types had much more of a role in the BLM/Antifa-related protests and riots than Antifa types had in anything of the past couple weeks. Of course, the right won't touch on that, just like how breaking windows of a police substation or stealing shoes from a department store is apparently on par with trying to murder politicians and overthrow government.
From what I've seen of the education system in much of the country, shitty parenting, and certain media outlets bleating the same brainwashed screed 24/7, I can easily believe that tens of millions are still falling for it and are 100% on board. The next 2 weeks might be some of the most dangerous times for the country.
-
@davesaddiction I'm not the only one being careless with the name.
-
@just-jeepin WTF...
-
@davesaddiction The complete lack of self-awareness is one of the defining characteristics of the Trumpists
-
A YouGov/Bright Line Watch poll from shortly after Biden won the election found that 48 percent of Trump supporters expected Trump to be inaugurated on Jan. 20. And around 20 percent of Trump supporters said they would resort to violence if Democrats won the election.
-
@davesaddiction Fortunately big talkers are rarely big walkers, but that’s not a good number
-
@just-jeepin Far too many walked on Wednesday. Hopefully all their moms lock them in their basement bedrooms until the 21st...
